In this “Response to Critics,” Cathleen Kaveny continues the conversation in the JRE symposium centered on her recent book, Prophecy without Contempt: Religious Discourse in the Public Square. The book's central argument is that adequate discussion of contention in the contemporary public square requires attending to matters of rhetoric, particularly the rhetoric of prophetic indictment. Cathleen Kaveny's Prophecy Without Contempt seeks to reorient the conversation among religious ethicists and political theorists about religion in public life. Rather than focus on religious speech in general, Kaveny distinguishes deliberation and indictment as forms of discourse, and she subjects indictment to ethical evaluation. She aims to constrain the public exercise of inordinate indictment, while encouraging prophetic indictment that meets the demands of justice. While the book is a much-needed corrective, Kaveny's focus on the powerful rhetoric of prophetic (...) indictment omits the harms that can come to the body politic from unjust silence. This essay takes a synthetic and critical approach to the scattered pieces of art criticism and aesthetic theory authored by Louis Althusser. Connecting these texts to his larger philosophical and political project, we argue that these reflections make an independent contribution to its worth and that they offer different perspectives on lingering theoretical problems. We piece together the insights that form the core of the Althusserian approach to aesthetics and show how these are formulated and trace how their formulations take (...) shape in relation to the work of different authors and artists. In addition to helping us better understand his overall project, Althusser’s aesthetic theory is, we argue, a powerful and original contribution to Marxist aesthetics. Specifically, it points us to the idea that we need to take aesthetic production seriously as a practice with its own specificity – one that has its own logics of determination, rituals of production, circulation, and consumption, one that commands effects that need to be theorized on their own terms. We agree that conceptualisation is key in understanding the brain basis of emotion. We argue that by conflating facial emotion recognition with subjective emotion experience, Lindquist et al. understate the importance of biological predisposition in emotion. We use examples from the anxiety disorders to illustrate the distinction between these two phenomena, emphasising the importance of both emotional hardware and contextual learning.

Introduction The bioethics literature reflects significant interest in and concern with the use of genetic and genomic information in various settings. Because psychiatric treatment and research raises unique ethical, legal, and social issues, we conducted a scoping review of the biomedical, bioethics, and psychology literature regarding the application of genetic and genomic tools to psychiatric disorders (as listed in the DSM-5) and two associated behaviors or symptoms to provide a more detailed overview of the state of the field. Objectives The (...) primary objective was to examine the available bioethics, biomedical, and psychology literature on applying genetic and genomic tools to psychiatric disorders (other than neurodevelopmental disorders) and two behaviors or symptoms sometimes associated with them (aggression or violence and suicidality) to identify the disorders to which these tools have been applied, the contexts in or purposes for which they have been applied, the ethical, legal, or social concerns associated with those uses, and proposed recommendations for mitigating those concerns. Methods We used Arksey and O’Malley’s scoping review framework: (1) identify the research question; (2) identify relevant studies; (3) select studies; (4) chart the data; and (5) collate, summarize, and report results (2005). We relied on Levac et al. to inform our application of the framework (2010). The PRISMA extension for scoping reviews checklist informed our reporting (2018). We searched three electronic databases MEDLINE (PubMed), Embase, and PsycInfo (EbscoHost) for peer-reviewed journal articles in English to identify relevant literature. One author screened the initial results and additional screening was done in consultation with other authors. A data extraction form using DSM-5 diagnostic categories (excluding neurodevelopmental disorders) was developed and two authors independently each reviewed approximately half of the articles. Inter-rater reliability was ensured by double-coding approximately 10% of the papers. An additional author independently coded 10% of the articles to audit the data. Results In 365 coded publications, we identified 15 DSM-5 diagnostic categories in addition to the two pre-selected behaviors or symptoms (aggression or violence and suicidality) to which genetic or genomic tools have been applied. We identified 11 settings in or purposes for which these tools were applied. Twenty-two types of ethical, legal, or social concerns associated with the application of genetic or genomic tools to these disorders or behaviors/symptoms were identified along with 13 practices or policies that could mitigate these concerns. Conclusion Genetic and genomic tools have been applied to a wide range of psychiatric disorders. These raise a range of ethical, legal, and social concerns. Additional research is warranted to better understand the concerns and effective ways to address them. Advancing the literature to identify relevant ethical, legal, or social concerns and solutions to those problems likely requires greater attention to specific applications of genetic or genomic tools to particular psychiatric disorders and associated behaviors/symptoms as well as broad stakeholder engagement. With each novel infectious disease outbreak, there is scholarly attention to healthcare providers’ obligation to assume personal risk while they care for infected patients. While most agree that healthcare providers have a duty to assume some degree of risk, the extent of this obligation remains uncertain. Furthermore, these analyses rarely examine healthcare institutions’ obligations during these outbreaks. As a result, there is little practical guidance for healthcare institutions that are forced to weigh whether or when to exclude healthcare providers from (...) providing care or allow them to opt out from providing care to protect themselves. This article uses the COVID-19 pandemic to examine the concept of risk and the professional duties of both healthcare providers and healthcare institutions, and proposes a framework that can be used to make concrete institutional policy choices. This framework should be a useful tool for any hospital, clinic, or health agency that must make these choices during the current pandemic and beyond. (shrink)

This is the second volume of philosophical essays by one of the most innovative and influential philosophers now writing in English. Containing thirteen papers in all, the book includes both new essays and previously published papers, some of them with extensive new postscripts reflecting Lewis's current thinking. The papers in Volume II focus on causation and several other closely related topics, including counterfactual and indicative conditionals, the direction of time, subjective and objective probability, causation, explanation, perception, free will, and (...) rational decision. There is a growing trend of refusal of blood transfusions from COVID-19 vaccinated donors. We highlight three cases where parents have refused blood transfusions from COVID-19 vaccinated donors on behalf of their children in the setting of congenital cardiac surgery. These families have also requested accommodations such as explicit identification of blood from COVID-19 vaccinated donors, directed donation from a COVID19 unvaccinated family member, or use of a non-standard blood supplier. We address the ethical challenges posed by these issues. We (...) describe the current screening and safety processes for standard blood donation and explore the importance of donor anonymity and challenges with directed donation and non-standard blood suppliers. We present an ethical framework using the Best Interest Standard, the Zone of Parental Discretion, and the Harm Principle when considering these refusals. Finally, we provide recommendations for how to approach these requests as they potentially become more commonplace in pediatrics. (shrink)

A growing body of work suggests that the presence of women and of independent directors on boards of directors is associated with higher corporate environmental performance. However, the mechanisms linking board composition to corporate environmental performance are not well understood. This study proposes and empirically tests the mediating role of sustainability-themed alliances in the relationship between board composition and corporate environmental performance. Using the population of public oil and gas firms in the United States as the sample, the study relies (...) on renewable energy alliances to measure sustainability-themed alliances and longitudinally analyzes lagged data for independent and control variables. The study found that the higher the representation of women on a firm’s board, the more likely the firm is to form sustainability-themed alliances, and the higher the representation of independent directors on a firm’s board, the more likely the firm is to form sustainability-themed alliances. Such alliances, in turn, positively contribute to corporate environmental performance. This paper discusses the study’s contributions to the board composition-social performance literature. (shrink)

The High Court continues to exercise its inherent jurisdiction to make declarations about interventions into the lives of situationally vulnerable adults with mental capacity. In light of protective responses of health care providers and the courts to decision-making situations involving capacitous vulnerable adults, this paper has two aims. The first is diagnostic. The second is normative. The first aim is to identify the harms to a capacitous vulnerable adult’s autonomy that arise on the basis of the characterisation of situational vulnerability (...) and autonomy as fundamentally opposed concepts or the failure to adequately acknowledge the conceptual relationship between them at common law. The second part of this aim is to draw upon developments in analytic feminist philosophy to illustrate how standard approaches to autonomy are ill-equipped to capture the autonomy issues of capacitous vulnerable adults when their decisions regarding care and treatment are at stake. The second (normative) aim is to develop an account of self-authorised, intersubjective autonomy on the basis of analytic feminist insights into the relational practices of recognition. This account not only attempts to capture the autonomy of capacitous vulnerable adults and account for the necessary harms to their autonomy that arise from standard common law responses to their situational vulnerability, it is also predicated on the distinctions between mental capacity, the satisfaction of conditions for informed consent and the exercise of autonomy, meaning that it is better placed to fulfil the primary aim of the inherent jurisdiction – to facilitate the autonomy of vulnerable adults with capacity. This article considers some of the ways in which ‘the black woman’ as both representation and embodied, sentient being is rendered visible and invisible, and to link these to the multiple and competing ways in which she is ‘present’. The issues are engaged through three distinct but overlapping conceptualisations of ‘presence’. ‘Presence’ as conceived (and highly contested) in performance studies; ‘presence’ as conceived and worked with in psychoanalysis; and ‘presence’ as decolonising political praxis among Indigenous communities. I use these conceptualisations (...) of presence to consider the various ways in which the black woman as figure and as embodied/sentient subject has been made present/absent in different discursive registers. I also explore what is foreclosed and how this is itself linked to legacies of colonial ‘worlding’. I end with consideration of alternative modes of black women's presence and how this offers a resource for new modes of sociality. (shrink)

This study examined how sales managers react to ethical and unethical acts by their salespeople. Deontological considerations and, to a much lesser extent, teleological considerations predicted sales managers' ethical judgments. Sales managers' intentions to reward or discipline ethical or unethical sales force behavior were primarily determined by their ethical judgments. An organization's perceived ethical work climate was not a significant predictor of sales managers' intentions to intervene when ethical and unethical sales force behavior was encountered.

Mona Simion has recently argued for a function-first norm of moral assertion. According to function-first accounts, the norm of any kind of assertion is determined by the function of that kind of assertion. She argues that, on the assumption that moral understanding is the goal of moral inquiry, the function of moral assertion is reliably generating moral understanding in others and that the norm of moral assertion should fall out of that function. In particular, she thinks the norm should be (...) such that satisfying it is the most reliable way for one’s moral assertions to generate moral understanding in others—at least when all else goes well. With this in mind, she proposes The Explanation Proffering Account of Moral Assertion. First, I argue that satisfying EPNMA is not the only or most reliable way for one’s moral assertion to generate moral understanding in one’s audience. I propose an alternative norm on which one must accompany one’s moral assertions with a maieutic speech act, i.e., an utterance in the form of a question or assertion that aims to elicit knowledge or other epistemic states from an audience. Second, I present counterexamples to EPNMA wherein speakers make moral assertions that violate EPNMA and yet they are not intuitively epistemically criticizable for their assertion. I conclude by briefly sketching an alternative account that avoids the pitfalls of EPNMA. (shrink)

In this article, the author argues that the question of educational time is absolutely essential in contemporary debates concerning the fate of the university. In order to examine the nature of educational time, this article first outlines Heidegger's distinction between temporality and Temporality. Second, the author makes a clarification between inauthentic and authentic learning as two forms of educational temporality. Here the article turns to the work of Hubert Dreyfus and Stuart Dreyfus on expert skill building versus standardised or generic (...) forms of learning. When inauthentic and authentic forms of temporality are brought to light through this distinction, new ways of understanding the convergence and divergence of learning modes open up for critical reflection. Third, the article suggests that while differentiations internal to learning are critical in the struggle to define the nature of education, education cannot be reduced to its temporalising forms. At this point, the work of one of Heidegger's late students, Giorgio Agamben, becomes important for grounding the educational experience in Temporality through study. At stake here is carving out a time in education for enpresencing versus self-projection through action. And finally, the article turns back to Hediegger in order to see the ethical limitations of too quickly collapsing education into learning—even if that learning is authentic. (shrink)

In this paper, I offer a novel defense of moderate pessimism about moral deference, i.e., the view that we have pro tanto reason to avoid moral deference. I argue that moral deference fails to give us the epistemic credentials to satisfy plausible norms of moral assertion. I then argue that moral assertions made solely on the basis of deferential moral beliefs violate a plausible epistemic and moral norm against withholding information that one knows, has evidence, or ought to believe will (...) importantly affect another person’s deliberation. Finally, I argue that not only does moral deference fail to put the audience in a good epistemic position it also puts the audience in a bad epistemic and moral position. First, there is a tight connection between outright believing something and being disposed to assert it and so deferential moral beliefs often motivate people to assert something that they don’t have the epistemic credentials to properly assertion. Second, there will often be moral reasons to make assertions—even based on deferential moral beliefs. These assertions, while all-things-considered permissible, will be epistemic impermissible and involve violating a moral norm. (shrink)

Einstein argued in his latter years that the intelligibility of the world was in the nature of a miracle, and that in no way could one have expected a priori such a high degree of order; this is why he rejected the atheist, positivist standpoint, and believed in a Spinozist God. Einstein's argument, however, is essentially a form of the ?argument from design? for a personal God based on the existence of beautiful, mathematically simple laws of nature; that physical order (...) is a unique, improbable alternative compared to the infinite number of chaotic universes that might have existed. Einstein, in his early manhood, was a Humean, but in later years, as he moved toward Spinoza, from phenomenalism to noumenalism, he clearly rejected Hume's restriction of probable inferences to observed sequences. Darwin's arguments against biological design did not apply to Einstein's argument, because the laws of physics are not the outcome of any cumulative struggle for existence and natural selection. Perhaps the beautiful simplicity of basic physical laws helps account for the fact that relatively more physicists than biologists or psychologists hold to a theistic standpoint. Einstein's finite universe would have seriously weakened the argument that life, though infinitely improbable, would have been realized in an infinite world. But in any case, Einstein would have regarded ?emergence? theories of life as irrational. In accordance with the principle of identity of Emile Meyerson, the epistemologist whom he most respected, it would have followed that the occurrence of consciousness and intelligence was grounded in a God with those attributes, and that theism was consequently the basis for scientific knowledge. Taking up where Michel Foucault ended, Agamben argues that the principle political and philosophical questions of the moment concern the connections between life and power. In (...) this sense, he stands in diametric opposition to one of the leading French intellectuals of our times: Alain Badiou. For Badiou, the key question of the present is not so much power and the body as it is the ethics of truth. According to Agamben, Badiou's project has abandoned thinking about the biopolitics of life and as such is both philosophically and politically suspect. But does Agamben's critique prematurely dismiss Badiou? In other words, does his critique prevent us from recognizing the precise location of biopolitics in Badiou's work? It is my contention that we must read Badiou not against but from within a biopolitical framework in order to realize both the validity of Agamben's criticism and its limitations. In fact, it is through the critical lens of biopolitical theory that we can begin to see the unique links in Badiou's thinking between aesthetics, the body, and education. In conclusion, I argue that Agamben provides insights missed by Badiou's reduction of the animal body to the disavowed grounds for the grace and beauty of truth, while at the same time Badiou provides Agamben's own theory of biopolitics with a unique educative practice: the practice of dance.Here I would like to justify this philosophical inquiry for educational theorists. With the fate of art-based educational programs uncertain in the [End Page 53] face of standardization, it is perhaps time to reassess legitimating claims for retaining arts education programs. By reading Badiou through Agamben, I hope to provide a new reason for advocating the centrality of dance in educational programs and assert the inherently educative qualities of movement-based curricula. Second, I hope to suggest in my conclusion that dance is an important form of educational practice antithetical to current forms of capitalist "bioproduction." As such, I will link together my own theory of dance education with the critical pedagogical tradition in order to anchor the "utopian imagination" in a practice of the body. This is an attempt to fill in a rather vague sphere of critical pedagogical research and theory: aesthetic practice. Overall, this article will bring together two important philosophical traditions—Agamben's biopolitical theory and Badiou's theory of truth—in order to examine their relation to education and, in turn, how education is a central concept for thinking through contemporary continental philosophical traditions.Biopower and Event: Situating the Subject in Relation to TruthMichel Foucault first coined the theoretical concept "biopower" in his work on the history of sexuality.1 In order to understand Foucault's meaning we must first separate biopower from sovereign power, which is characterized by the "right to decide life and death."2 The sovereign—which for Foucault is not simply a form of territorial rule but is a principle of power relations—decides who lives and who dies. Power here is the power of the sword that marks the body directly through overt forms of public torture and violence. But in the classical age and with the rise of capitalist social relations, the form and function of power switched. Famously, Foucault wrote that the highest function of power "was perhaps no longer to kill, but to invest life through and through."3 This new form of power—whose concern was no longer death but the maintenance and regulation of life—operates on two interconnected levels. First, biopower conceives of the body as a machine, which must be disciplined in order to be made more efficient. Here, power acts as microphysics, training the individual body in order to reach a high level of social efficiency. Second, on the macro level, biopower transforms the populous into a population that has to be carefully regulated in terms of propagation rates, health levels... (shrink)

Bradley and Whitehead certainly deserve a book-length comparison on such topics as experience, internal and external relations, particularly whole-part relations, time, and God. Leemon McHenry has explored these issues soberly and responsibly, and his conclusions are most informative. Yet I sometimes wonder whether the connection would be as firmly made had there not been one remark about Bradley in the preface to Process and Reality.

The concept of the analyst's presence gained attention almost 60 years ago through the writings of the French analyst Sacha Nacht and the Hungarian-British Michael Balint. Anna Freud earlier spoke of the related, but rather ambiguous term "real person of the analyst," which has been widely discussed by many authors since. Both terms- presence and real person- appear frequently in the psychoanalytic literature, usually without much definition or conceptual clarity. Authors have used them in different ways, but in general their (...) intention has been to contrast the analyst's reality as a person with his function as a transference and fantasy object, perhaps as a corrective to the perceived austerity of the classical « one-person » model. Lacan's work represents an exception in attempting to escape the dialectic between intra and inter-psychic, but at the cost of eliminating the influence of the analyst as another subject. In contrast to metapsychologic theories of the mind, the author argues that "real presence" can be better understood as part of the phenomenologic experience of intersubjectivity, The co-presence of the analyst is fundamental to the encounter, rather than an accidental or intentional disruption. The chapter confines itself to only few letters on only a few topics. David's metaphysics sometimes takes the form of philosophical theology, especially in his correspondence about the free will theodicy. It presents selections of David's correspondence on topics in the philosophy of religion: a letter on (...) evil, specifically on the possibility of divine evil, evil perpetrated by God a letter on evil. The chapter concludes with a discussion of the place which, according to the author, God must have in David's logical space and also of the success of the many‐worlds theodicy that David briefly discusses. Recent years have seen an increased interest in black feminism. Whether thinking of the explosion of activism, the reprinting of classics such as Heart of the Race (Bryan, Dadzie and Scafe, 2018 [1985]) and Finding a Voice (Wilson, 1978) or the numerous journalistic or scholarly inquiries into black feminist formations in Britain in the 1970s–1990s, black feminism is a topic of interest once again. Sometimes it goes under other names: POC feminism, Womanism, Fugitive Feminism—each of which offers a specific inflection (...) of this thing I am calling black feminism. Given this context, my aim in this article is to consider how black feminism might be conceived—what kind of an object it is, but more importantly how it might be ‘used’ and utilised as a vibrant and well-honed tool in the armory with which we attempt to craft a politics of ethical freedom. I attempt to draw together work from the theoretical archive of black women’s writing with that of psychoanalyst Donald Winnicott and his theorisation of ‘object use’ and ‘play’, as foundation stones in the development of a capacity for ethical relating based on the detoxification of racism’s effects on ‘self’, ‘other’ and the intersubjective field that the space between these constitutes. In my mind, the piece is a ‘call’ hoping for a ‘response’, the chorus is ‘black feminism’. (shrink)

Ainslie’s contribution offers a useful refinement of his powerful model of intertemporal bargaining. However, he focuses mostly on the cognitive mechanisms of choice. I suggest that these interact with emotional, personality, and developmental dynamics that cannot be ignored, either psychologically or neurally.

This essay shows that comparable notions of humanism emerged independently in two twentieth-century scholars, Yuen Ren Chao (1892–1982) and George Sarton (1884–1956). They met as young men at Harvard University and found themselves to be compatible thinkers. They both respected the so-called facts of science, perhaps more than theories in science. They saw their task as assembling these facts for a future synthesis. They recognized the diversity of the world’s civilizations, and they actively participated in trying to unite scholars of (...) good will.
